      This Privacy Policy explains how Duncan French ("Duncan French," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit duncanfrench.com (the "Site"), submit a contact form, contact us by email or telephone, or otherwise interact with us.

      For purposes of applicable data protection law, Duncan French is the controller of the personal information described in this Privacy Policy.

      1. Personal Information We Collect

      Information you provide

      Depending on how you contact us, we may collect:

      • your name;
      • your email address;
      • your telephone number;
      • the contents of your message or comment;
      • your communication preferences and a record that you were shown this Privacy Policy; and
      • any other information you choose to provide when communicating with us.

      Please do not include medical or health information, financial information, government identification numbers, passwords, or other sensitive information in a general contact form.

      Information collected automatically

      When you visit the Site, our website hosting, content delivery, security, and technical service providers may automatically process limited technical information needed to deliver and protect the Site, including:

      • Internet Protocol (IP) address;
      • browser and device type;
      • operating system;
      • requested page or file;
      • referring page;
      • date and time of the request; and
      • security, error, and server log information.

      We do not currently use Google Analytics, Meta Pixel, advertising pixels, or similar analytics or advertising tracking tools on the Site.

      2. How We Use Personal Information

      We use personal information to:

      • operate, deliver, maintain, troubleshoot, and secure the Site;
      • respond to inquiries and provide information you request;
      • contact you by email or telephone about your inquiry;
      • evaluate a request for services and take steps before entering into a contract;
      • provide services and manage a client relationship;
      • maintain appropriate business, tax, accounting, and legal records;
      • prevent fraud, spam, misuse, and security incidents;
      • comply with applicable law and lawful requests; and
      • establish, exercise, or defend legal claims.

      We do not use personal information collected through the Site for automated decision-making or profiling that produces legal or similarly significant effects.

      3. Telephone Numbers, Calls, and Text Messages

      When you submit a telephone number, we use it to respond to your inquiry and communicate with you about the services you requested or asked about.

      Submitting a telephone number through a general contact form is not consent to receive recurring automated or prerecorded marketing calls or marketing text messages. We will request separate consent before sending such communications if consent is required by law. You may ask us to stop contacting you at any time by replying to us or using the contact information in Section 13.

      4. Legal Bases for EEA and UK Visitors

      If the European Economic Area ("EEA") or United Kingdom data protection laws apply to our processing, we rely on one or more of the following legal bases:

      • Legitimate interests: to operate and secure the Site, prevent fraud and misuse, respond to ordinary business inquiries, communicate with prospective clients, and protect our legal rights. We consider and balance these interests against your rights and interests.
      • Steps before a contract and performance of a contract: to respond when you ask about services, prepare a proposal, enter into an agreement, and provide contracted services.
      • Legal obligation: to keep records or disclose information when required by applicable law.
      • Consent: where we specifically ask for consent for an optional activity. You may withdraw consent at any time, without affecting processing that occurred before withdrawal.

      You are not legally required to provide information through a contact form. If you do not provide the fields marked as required, however, we may be unable to respond to or properly evaluate your inquiry.

      5. Cookies and Third-Party Website Features

      The Site may use cookies or similar technologies that are strictly necessary for security, network management, form operation, or other functionality you request. We do not currently use analytics or advertising cookies.

      The Site currently uses or links to the following third-party features:

      • Google Fonts. The Site loads certain fonts from Google servers. When a font is requested, Google may receive technical information such as your IP address, browser information, and the referring page.
      • Instagram and other external links. If you follow a link to Instagram or another third-party website, that third party processes information under its own privacy notice. We do not control the privacy practices of external websites.

      You can configure your browser to block or delete cookies. Blocking strictly necessary technologies may affect Site functionality. Where applicable law requires consent for a non-essential technology, we will request consent before activating it.

      6. How We Disclose Personal Information

      We may disclose personal information only as reasonably necessary to:

      • Service providers: providers supporting website hosting, content delivery, security, contact forms, email, communications, cloud storage, and IT administration. These providers process information to provide services to us and are expected to protect it appropriately.
      • Professional advisers: lawyers, accountants, insurers, and other advisers where reasonably necessary for their services.
      • Authorities and legal recipients: courts, regulators, law enforcement, or other parties when disclosure is required or permitted by law, necessary to respond to legal process, or appropriate to protect rights, safety, and security.
      • Business transaction parties: a prospective or actual buyer, successor, adviser, or other participant in a merger, financing, reorganization, sale of assets, or similar transaction, subject to appropriate safeguards.
      • Recipients you direct: another person or organization when you ask or authorize us to disclose information.

      We do not sell personal information for money. We do not share personal information for cross-context behavioral advertising and do not process it for targeted advertising.

      7. Retention

      We retain personal information only for as long as reasonably necessary for the purposes described above:

      • contact-form submissions and general inquiries: generally up to 24 months after the last substantive communication;
      • client, contract, transaction, tax, and accounting records: generally up to seven years after the end of the relevant relationship or transaction;
      • security, diagnostic, and server logs under our control: generally up to 12 months; and
      • privacy request records: generally up to three years after the request is completed.

      We may retain information for a longer period when required by law or reasonably necessary for a dispute, investigation, legal hold, fraud prevention, or the establishment, exercise, or defense of legal claims. When information is no longer required, we take reasonable steps to delete, destroy, or deidentify it.

      8. Data Security

      We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. However, no Internet transmission or storage system is completely secure, and we cannot guarantee absolute security.

      9. International Processing

      Duncan French is located in the United States. If you access the Site or contact us from another country, your personal information may be transferred to and processed in the United States and in other countries where our service providers operate. These countries may have privacy laws that differ from those in your country.

      Where EEA or UK law applies and an international transfer requires safeguards, we use a legally recognized transfer mechanism where required, such as an adequacy decision, approved standard contractual clauses, the UK International Data Transfer Addendum, or another lawful safeguard. You may contact us for more information about safeguards relevant to your personal information.

      10. Your Privacy Rights

      Depending on where you live and the law that applies, you may have the right to:

      • request access to personal information we hold about you;
      • request correction of inaccurate or incomplete information;
      • request deletion of personal information, subject to legal exceptions;
      • request restriction of processing;
      • object to processing based on legitimate interests or for direct marketing;
      • receive certain information in a portable format;
      • withdraw consent where processing is based on consent;
      • opt out of the sale or sharing of personal information, targeted advertising, or certain profiling; and
      • appeal a refusal to act on a request and receive non-discriminatory treatment for exercising a privacy right.

      We do not currently sell or share personal information for cross-context behavioral advertising, use it for targeted advertising, or conduct qualifying automated profiling.

      To exercise a right, email duncan@dfsignatureperformance.com with the subject line Privacy Request and describe your request. We may ask for information reasonably necessary to verify your identity and locate relevant records. We will respond within the time required by applicable law.

      An authorized agent may submit a request where permitted by law. We may request proof of the agent's authority and may need to verify your identity directly.

      If EEA or UK data protection law applies, you also have the right to lodge a complaint with the data protection authority in the country where you live or work, or where you believe a violation occurred. We encourage you to contact us first so we can try to address your concern.

      11. Additional Information for U.S. Residents

      During the 12 months before the effective date of this Privacy Policy, we collected or may have collected the following categories of personal information:

      • identifiers and contact information, such as name, email address, telephone number, IP address, and online identifiers;
      • Internet or other electronic network activity, such as requested pages and server log information; and
      • the contents of inquiries and other communications you send to us.

      We collect this information directly from you and automatically from your browser or device. We use and disclose it for the purposes and to the recipient categories described in Sections 2 and 6. We do not knowingly collect sensitive personal information through the Site and ask that you not submit it through a general contact form.

      We have not sold personal information for money or shared personal information for cross-context behavioral advertising. We do not knowingly sell or share the personal information of anyone under 16. We do not offer financial incentives in exchange for personal information.

      If an applicable U.S. state privacy law grants you rights, you may exercise them as described in Section 10.

      12. Children's Privacy

      The Site is intended for a general adult audience and is not directed to children under 13. We do not knowingly collect personal information online from a child under 13. If you believe a child has submitted personal information through the Site, contact us so we can review and delete it where required by law.
